AlliedSignal, Inc., et al. v. Shirley Ott
Thursday, May 16, 9:30 a.m.
Ott is suing several companies based on asbestos-related injuries allegedly suffered by her
late husband throughout his working life. Defendants moved for summary judgment and
argued that the Product Liability Acts ten-year statute of repose bars Otts claims.
The Allen Superior Court denied the defendants motion for summary judgment.
The court ruled that the statute of repose does not apply to asbestos-related
claims like Otts and that barring such claims would violate Art. I, §
12 and Art. I, § 23 of the Indiana Constitution. In this
interlocutory appeal of that order, the Indiana Supreme Court has granted an emergency
transfer of jurisdiction and scheduled oral argument.
