CITY OF GARY, INDIANA V. INDIANA BELL TELEPHONE CO.
The City of Gary enacted an ordinance designed to collect a fee from
telecommunications providers that would be used to provide City residents with free access
to the internet. Indiana Bell challenged the fee as an impermissible tax.
The Court of Appeals ruled in favoring Indiana Bell, and the City
of Gary petitioned to transfer.
