Court's Notice On Right To Request Settlement Conference (Microsoft Word) - updated 12/1/15
Pursuant to I.C. 32-30-10.5-8(d), Indiana trial courts have been required since June 30, 2011 to send a notice informing eligible mortgage foreclosure debtors* of their right to request and participate in a settlement conference. This notice must provide the debtor with information on how and when to request a settlement conference with the court.
*This notice is not required in situations in which the mortgage is secured by property that is not the debtor's primary residence or if the debtor has defaulted on a previous foreclosure prevention agreement or recently declared bankruptcy.
Pre-Suit Notice (for Creditor Attorneys) (PDF) - updated and effective 12/1/15
The Indiana Housing and Community Development Authority (IHCDA) has prescribed the attached language for the pre-suit notice required under Indiana Code 32-30-10.5-8(a). A Spanish version is available online at ihcda.in.gov.
Mortgage Foreclosure Best Practices (PDF)
In October 2010, the Division of State Court Administration convened a task force composed of representatives from the Office of the Attorney General, trial court judges, lenders’ counsel, debtors’ counsel, academics, and MFTCAP facilitators to draft a list of “best practices” to assist trial courts in handling mortgage foreclosure cases. Per the Supreme Court's October 2011 Order in 94S00-1101-MS-3, these Best Practices are periodically updated and amended by the Task Force.

The Indiana Housing and Community Development Authority (IHCDA) has prescribed the attached language for the notice required under Indiana Code 32-30-10.5-8(c), to be included on the first page of the summons served on the debtor in a foreclosure action filed after June 30, 2011. This Summons is to be directed only to the maker of a promissory note.
