Notice of Proposed Rule Amendments by the Indiana Supreme Court Committee on Rules of Practice and Procedure for Public Comment

To the Bench, Bar and Public:

Pursuant to Ind. Trial Rule 80, the Indiana Supreme Court Committee on Rules of Practice and Procedure has posted the following:

1 Proceedings Supplemental

The amendment changes the way interrogatories are served on garnishee defendants and removes the requirement that a garnishee defendant appear at the hearing on proceedings supplemental.

2 Time for response to petition in Tax Court

The amendment repeals the automatic enlargement of time to respond to a petition.

3 Disqualification of a judge

This amendment would permit waiver of judicial disqualification in certain circumstances. Such waiver must be on the record and reduced to a writing signed by the parties.

4 Service of summons on individuals

When service is made by leaving the summons and complaint at the defendant's dwelling or usual place of abode, the summons and complaint must be left with a suitable person.

5 Proof of service of summons

This amendment requires, when service is made on a person other that the defendant plaintiff, a statement as to the name or other identification of the person accepting service.
