IMPORTANT NOTICE TO FILERS OF TRAVEL INSURANCE FORMS AND RATES

You will no longer have to make separate filings under Property/Casualty and Accident/Health for products that ‘bundle’ both exposures.  Travel filings may be made under either a 1B or 2A licensure, but all travel filings should be submitted under the NAIC A&H TOI as they will be reviewed by the A&H analysts.  This brings you the opportunity to file group platform products which could not be done previously under P&C rules.  This change of procedure is effective June 1, 2008.  Any filings received on or after that date will be handled as outlined above.  Please contact us with any questions you may have:  Carol Cutter, 317-232-5695, ccutter@idoi.in.gov; or Paul Hyslop, 317-232-2421, physlop@idoi.in.gov.

Through an arrangement between Perr & Knight and the Indiana Department of Insurance, all policy forms, rates and rule filings with the Department of Insurance are scanned and made available to the public online.

The Department of Insurance continues to provide access to paper copies of all filing information at no charge to members of the public. Access to original filings may be obtained by first calling ahead, requesting the specific filings desired, and arranging an appointment to view the documents at IDOI offices located at 311 West Washington Street, Indianapolis, Indiana.

Rate and Form Submission Requirements

Notice of new product filing fees!
Under IC 27-1-3-28, effective 7/1/07, the following fees will apply to all rate and form product filings in all classes of business:

Each insurer shall remit to the commissioner for deposit into the Department of Insurance fund established by section 28 of this chapter, a fee of $35 for each policy, rider, rule, rate, or endorsement filed with the state including subsequent filings. Except as provided in subsection (f), each policy, rider, rule, rate, or endorsement that is filed as part of a particular product filing or in association with a particular product filing is an individual filing subject to the fee under this subsection. However, the total amount of fees paid under this subsection by each insurer for a particular product filing may not exceed one thousand dollars ($1,000).

Retaliatory provisions (under IC 27-1-20-12) still apply.

  1. Revisions in a product filing before it is completed by the Department are not subject to any additional fee. However, any subsequent changes to the filing after completion will generate new filing fees, including any applicable retaliatory fees.
  2. Entities within the same insurance group making simultaneous identical filings must each pay the filing fees.
  3. Filings made by a rating organization on behalf of their members or subscribers are subject to these filing fees. Members or subscribers who deviate from the rating organization's filing, or file loss cost multipliers, are subject to the fees.
  4. Reference filers and service purchasers must pay the filing fees.
  5. Manuals or manual pages are not required to be filed. If a company chooses to submit these as additional information, no fee applies. Any filings made to delay or non-adopt a rating organization's filing are not subject to the fees.

All Product Filing Fees Will Be Billed Quarterly

The Department no longer accepts filing fees submitted with any filing. We will bill all filers on a quarterly basis for any filing submissions. Quarterly bills will include fees for all filings submitted via paper or SERFF.
Remittances for all quarterly billed filings should be made payable to the Indiana Department of Insurance

Electronic Filing Procedures through SERFF

All property/casualty product lines and all life and annuity product lines filings for policies, rates, forms, rules, or endorsements may be filed through SERFF.

All accident/sickness product lines policies, forms, or endorsements may be filed through SERFF. Currently, we prefer to not receive rates for these product lines through SERFF. Therefore, any rates only, or combination filings of forms and rates will still need to be filed via paper.

General Rules for all Product Filings

  1. Include a properly completed NAIC Transmittal Document with all appropriate forms, rate & rule schedules.
  2. Use the NAIC Uniform Coding Matrix when necessary.
  3. A cover letter is not required but may be included if there is additional information that would be helpful in the product review.
  4. For paper filings, include a postage-paid, self-addressed envelope of adequate size to accommodate the return of the 'approved' or 'stamped' filing.
  5. All policies, applications, riders, etc. must be in final print form with the appropriate form numbers listed in the lower left corner of at least the first page of each form.

    Form numbers cannot be variable.

  6. When a filing is submitted by an outside consulting firm, a letter giving authorization to file on behalf of the company(s) is required. When filing for multiple companies, please pre-sort the materials by company before submitting.
  7. Foreign language versions of all forms must be filed. A foreign language version filing must include:
    1. English version of the form with prior approval date (if filed separately).
    2. Translator's certification of the accuracy of the English translation version as per Bulletin 106.
    3. We recommend the English version be filed first, independent of the foreign version, to save translation costs or the need for a new certification for every correction or change made.

Accident and Sickness Filings

Accident and sickness Filings should include:

  1. The appropriate completed checklist for the product being filed. Checklists for individual, group, out-of-state, HMO (both group and individual), Medicare supplements, long-term care, and blanket policies are posted on the website.
  2. The 'Location in Submitted Documents' column on the checklist must be completed to indicate the exact location of the required provision within the filing. i.e.form xxx, page xx, section x.
  3. All policies, applications, riders, etc. must be in final print form with the appropriate forms numbers listed in the lower left corner of at least the first page of each form. Form numbers cannot be variable.
  4. A Flesch readability certification per IC 27-1-26.
  5. An actuarial memorandum with accompanying rates for all individual and group health filings. All rates should be submitted with the accompanying policy forms unless you are requesting rate changes on previously approved forms. If rate changes only are filed, include the form numbers of all forms affected by the rate change.

Property and Casualty Filings

Property and Casualty Filings must include:

  1. All rates, rules and forms, unless excepted by statute. Non-contractual forms not a part of the policy do not need to be filed. Rates must be supported and where the experience data is credible, must include actuarial justification.
  2. Worker's compensation rate filings should be submitted 30 days prior to the effective date.
  3. Statements not to adopt or delay a Bureau filing do not require a filing fee.

Life and Annuity Filings

Life and Annuity Filings must include:

  1. All policies, applications, riders, etc. must be in final print form with the appropriate form numbers listed in the lower left corner of at least the first page of each form.
    Form numbers cannot be variable.
  2. A Flesch readability certification per IC 27-1-26.
  3. Any advertisement, endorsement, rider or application to be used with a product filing. Filing fees apply to these forms.
  4. Please reference the 'Life and Annuity Review Standards' located on our website.
