Closing A Waste Tire Facility and Ending Its Registration

  • If you are a registered facility that wants to close operations and discontinue your registration(s), you must notify IDEM using the Waste Tire Facility Closure Notification, State Form 55351 (available on the IDEM Forms page).

If you are a waste tire transporter, you must submit the closure notification form at least 30 days before you intend to discontinue your operation. Once you send us the closure notification form, we will send you a closure letter stating you are no longer required to maintain financial assurance. After you receive this letter, you may notify your bank or other financial institution that your bond or other financial assurance mechanism can be released. You must not discontinue your financial assurance until we have approved you to do so.

If you operate a waste tire storage site and/or processing operation, you must submit the closure notification form after the facility meets the closure requirements in 329 IAC 15-3-21. Once you submit this form, an IDEM compliance inspector will conduct a compliance inspection to determine that you have properly closed and removed all waste tires from your facility. You must maintain your registration, and financial assurance, if applicable, until you meet the closure requirements. IDEM may cite you for violations and/or claim your financial assurance to complete the closure requirements if you do not meet the closure requirements in 329 IAC 15-3-21.

Once you complete the closure requirements, submit the closure notification form, and we complete our closure inspection (where required), we will send you a closure letter stating that that you no longer need to maintain financial assurance. After you receive this letter, you may notify your bank or other financial institution that your bond or other financial assurance mechanism can be released. You must not discontinue your financial assurance until approved to do so by IDEM.
