Proof of Publication
A proof of publication in a newspaper of general circulation in the project site area must be included with the NOI letter submittal. The actual proof of publication from the newspaper is required to be submitted as an attachment to the Notice of Intent. If the proof of publication is not available, a legible photocopy of the notice, the name of the newspaper, and the date(s) that the notice appeared is acceptable.
According to 327 IAC 15-5-5(a) (9), the public notice must include the following information:
- Company name and address
- Statement that a Notice of Intent will be filed with to the Indiana Department of Environmental Management as required by 327 IAC 15-5 to discharge storm water from construction activities
- Name of the project
- Address or location of the project
Note: The address of the project is required; however it is also acceptable to identify the site by a legal description (Latitude/Longitude or Section, Township, and Range)
- Identification (name) of the stream, creek, etc. that will receive run-off from the project site
Note: Notices that do not contain the required information will be considered deficient. IDEM will require that a new public notice be placed in the newspaper and submitted to the IDEM.
Sample Proof of Publication
XERT Development Inc. (10 Willow Lane, Indianapolis, Indiana 46206) is submitting a Notice of Intent to the Indiana Department of Environmental Management of our intent to comply with the requirements of 327 IAC 15-5 to discharge storm water from construction activities associated with Water Garden Estates located at 24 Washout Lane, Indianapolis, Indiana 46206.
