AMENDMENT TO AGREED ORDER OF AUGUST 14,
2020
Come now the parties of this cause, and desiring to modify and amend the Agreed Order
entered in this case on August 14, 2020, hereby consent to the following
amendments to the Agreed Order of August 14, 2020.
Agreed Modification
1.
This Amendment shall modify paragraph 16 of the
Order section of the Agreed Order.
The existing language in paragraph 16
shall be replaced with the following:
16. Respondent is assessed and agrees to pay
a civil penalty of Twenty-Nine Thousand Four Hundred Dollars ($29,400.00). Said
penalty amount shall be due and payable to the Environmental Management Special
Fund in twelve (12) monthly installments. The monthly installment payments
shall be Two Thousand Four Hundred Fifty Dollars ($2,450.00) each. The first
installment shall be due by January 31, 2021 and the remaining payments shall
be made every thirty (30) days thereafter. Interest shall accrue on unpaid
amounts at the rate established by IC 24-4.6-1-101.
2.
Modification of the
August 14, 2020 Agreed Order is limited to the item specifically addressed in
the document. All remaining portions of the Agreed Order remain in full force
and effect.
3.
This amendment t the
Agreed Order shall be effective (“Effective Date”) when it is approved by the
Complainant shall have no force or effect until the Effective Date.
