AMENDMENT TO AGREED ORDER OF MARCH 19,
2019
Come
now the parties of this cause, and desiring to modify and amend the Agreed
Order entered in this case on March 19, 2019, hereby consent to the following
amendment to the Agreed Order of March 19, 2019.
Agreed Modification
1.
This Amendment shall modify paragraph 4 of the
Order section of the Agreed Order.
The existing language in paragraph 4 shall be
replaced with the following:
4. Respondent is assessed and agrees to pay
a civil penalty of Twenty-Seven Thousand Dollars ($27,000). Said penalty amount shall be due and payable to the Environmental
Management Special Fund in twenty-four (24) monthly installments. The first installment of One Thousand One
Hundred and Twenty-Five Dollars ($1,125) shall be paid within thirty (30) days
of the Effective Date; the 30th day being the “Due Date”. Thereafter, subsequent monthly payments in the amount of One Thousand One Hundred and Twenty-Five
Dollars ($1,125) shall be due on the
30th day being the “Due Date”.
2. Modification
of the March 19, 2019 Agreed Order is limited to the item specifically
addressed in the document. All remaining
portions of the Agreed Order remain in full force and effect.
3.
This Amendment
to the Agreed Order shall be effective (“Effective Date”) when it is approved
by the Complainant or his delegate, and has been received by the
Respondent. This amendment shall have no
force or effect until the Effective Date.
