May 2013: Boiler Area Source NESHAP Initial Notifications due Jan 20, 2014
On December 20, 2012, the U.S. Environmental Protection Agency (U.S. EPA) finalized changes to the rule (40 CFR Part 63, Subpart JJJJJJ) regulating existing and new industrial, commercial, and institutional boilers located at area source facilities. An area source facility emits or has the potential to emit less than 10 tons per year (tpy) of any single air toxic or less than 25 tpy of any combination of air toxics. The final rule applies to boilers located at area source facilities that burn coal, oil, biomass, or non-waste materials, but not boilers that burn only gaseous fuels (including but not limited to natural gas, process gas, landfill gas, hydrogen, LPG) and or any solid waste as defined in 40 CFR Part 241. The vast majority of area source boilers are estimated to be located at commercial and institutional facilities and generally owned or operated by small entities.
Compliance dates are as follows:
- Initial Notification of Applicability due by January 20, 2014 or within 120 days of startup of a new source.
- Energy Assessment due by March 21, 2014
- Tune-up due by March 21, 2014
- Notice of Compliance Status is due by July 19, 2014 or 120 days after Energy Assessments, Tune-ups, and/or Performance Testing is conducted. Notice of Compliance Status must be submitted via the U.S. EPA Central Data Exchange (CDX); however for a limited time a paper submittal will be accepted until the Compliance and Emissions Data Reporting Interface (CEDRI) through the U.S. EPA Central Data Exchange is developed.

Tune-ups must be completed prior to March 21, 2014 and include the following:
- Measure concentrations in the effluent stream of carbon monoxide and oxygen in parts per million (PPM) by volume before and after adjustments are made to the burner
- Inspect burner or clean or replace any components as necessary
- Inspect the flame pattern and adjust the burner as necessary
- Inspect the air-to-fuel ratio system (Oxygen Trim System) and adjust as necessary
- Optimize total emissions of carbon monoxide

Energy Assessments are a onetime requirement for existing boilers that were purchased or rebuilt prior to June 4, 2010.
