November 2010: New Rules to Limit Volatile Organic Compound Emissions in Indiana
New rules have been added to 326 IAC Article 8 concerning emissions of Volatile Organic Compounds (VOCs) from Architectural and Industrial Maintenance (AIM) Coatings and Consumer and Commercial Products (CCPs). These rules limit the amount of VOCs that Indiana manufacturers and importers can put into their products in order to meet the United States Environmental Protection Agency’s newly issued 8-hour ozone National Ambient Air Quality Standard.
326 IAC 8-14: Architectural and Industrial Maintenance (AIM) Coatings
AIM coatings include varnishes, shellacs, stains and lacquers which contain solvents that when applied to a surface evaporate and create VOCs. The new rule intends to regulate any person who supplies, sells, offers for sale, or manufactures any AIM coating as well as any person who solicits* the application of any AIM coating within the state of Indiana. The rule also contains VOC content requirements and application standards for traffic marking coatings during the ozone season (May 1 - September 30). The new rule requires compliance with the following:
- VOC limits (grams/liter and pounds/gallon)
- Work practices
- Container labeling (description of the product and its use)
- Recordkeeping and reporting
- Compliance provisions and test methods
The AIM Coatings rule will become effective in Indiana on December 1, 2010. Beginning October 1, 2011, all AIM Coatings products manufactured, blended, repackaged for sale, supplied, sold and solicited for application within the state of Indiana must not exceed the VOC content limits stated in 326 IAC 8-14.
326 IAC 8-15: Consumer and Commercial Products (CCPs)
There are over 170 consumer products listed in the new regulation with VOC content limits which include items like adhesives, deodorants, household cleaners, hair spray and insecticides. The new regulation will apply to any person who sells, supplies, offers for sale or manufactures consumer products for use in Indiana. The new rule contains the following:
- VOC standards for over 170 CCPs
- List and definition of all CCPs with VOC content limits
- Product Labeling (date or code)
- Recordkeeping and reporting
- Test methods
The Consumer and Commercial Products rule will become effective in Indiana on December 1, 2010. Beginning June 1, 2011 any person that sells, supplies, offers for sale or manufactures for sale in Indiana any consumer product that contains VOCs must not exceed the VOC content limits specified in 326 IAC 8-15.

* The draft rule defines “solicit” at 326 IAC 8-14-2(61) as follows: “Solicit” means to require for use or to specify, by written or oral contract. For instance, if you are hiring a painting company to paint your office, you are required to state in the written or oral contract that the paint used by the company must meet the VOC limit. The painting company would then have the responsibility to comply with that contract (whether written or oral). This information should be readily available from the paint manufacturer.
