2008 Amendments to the Spill Prevention, Control, and Countermeasure (SPCC) Rule

On December 5, 2008, the Federal Register published U.S. EPA's amendments to the SPCC rule to increase clarity, tailor requirements to particular industry sectors, and to streamline certain requirements for facility owners or operators subject to the rule. The revised rule should result in greater protection to human health and the environment. In order to be subject to the SPCC rule a facility has to meet three criteria:

  1. it must be a non-transportation-related facility;
  2. it must have an aggregate above ground storage tank (AST) capacity of greater than 1,320 gallons or a buried capacity greater than 42,000 gallons; and,
  3. the facility must reasonably be expected to discharge into or upon navigable waters of the U.S.

U.S. EPA has delayed the effective date of the final rule that amends the SPCC regulations. The amendments will become effective on January 14, 2010. To learn more, you can also view the Finalized Amendments to the SPCC Rule for more detailed information.
