If a facility’s ownership is changing, facility representatives are required to submit a Notice of Termination/Exclusion (NOT/E) Letter (State Form 54087 available on the IDEM Forms page) to IDEM. Once approved, the submittal of an NOT/E will terminate permit coverage for the facility under Rule 6.

Rule 6 permits are nontransferable. If a facility comes under new ownership, representatives from the previous ownership (i.e., permit holder) must submit a Notice of Termination request within 30 days of the transfer. The new ownership must then apply for Rule 6 coverage within 60 days of the transfer.
