The term length of a Rule 5 permit is 5 years. IDEM has established the Notice of Intent receipt date as the actual start of permit coverage. Permits are required to be renewed Ninety (90 days) prior to the expiration of the permit (see Permit Renewal).

If the actual start of construction/land disturbing activity precedes submittal of the Notice of Intent, a violation of the Rule, the start of permit cycle will be determined as the actual start date of land disturbing activity.
