IDEM > Environmental Cleanup > State Cleanup > State Cleanup: Environmental Restrictive Covenants (ERC) State Cleanup: Environmental Restrictive Covenants (ERC)

Following delineation of the nature and extent of contamination, an ERC (similar to a deed restriction) may be used as an institutional control for closure on select sites that do not pose an unacceptable risk to human health or the environment. For example, an ERC may prohibit the use of potable groundwater at a site, or prevent exposure to subsurface soil contamination. Please contact your project manager for additional information.

Example of an ERC and Affidavit [DOC]

Additional information may be found in Appendix 5 of the IDEM RISC Technical Guide [PDF] and in the ERC Submittal Preparation Guidelines [PDF] document.
