Indiana Attorney General Steve Carter Takes Action against 13 Companies and their Owners for Sending Hoosiers Unsolicited Faxes

INDIANAPOLIS, IN – Eight companies that have sent Hoosiers hundreds of unwanted offers for vacation packages, weight loss products, loans, health and life insurance,  are now named in lawsuits filed by Indiana Attorney General Steve Carter.  Five others have been cited for alleged violations and have paid penalties since enforcement of the law began January 1, 2007.

“These fax offers are frustrating for business owners who bear the brunt of the costs along with the time to sort through the unwanted piles of paper each day,” Carter said. “Home-based businesses also have the added frustration of interrupted privacy during the owners’ time spent with family.”

Five companies have entered into assurances of voluntary compliance (AVC) with the attorney general’s office for alleged violations of the law, paying penalties of $13,250.

The state law makes the transmittal of unsolicited fax advertisements a deceptive consumer sale act allowing the attorney general’s office to recover civil penalties of up to $1,500 per violation.
