[SOS] Secretary of State investigation leads to charges filed in securities fraud case

INDIANAPOLIS (November 23, 2015) — An investigation by Indiana Secretary of State Connie Lawson’s Prosecution Assistance Unit led to the filing of criminal charges by Hamilton County Prosecutor D. Lee Buckingham II against Steven Garland. Charges filed against Garland include securities fraud, conducting business as an unregistered broker dealer and conversion.  Garland is currently in custody in Hamilton County. 

“Investors should always check with the Secretary of State’s office to make sure the investment advisor and the product are licensed before investing,” said Secretary Lawson. “This case is the perfect example of how a simple background check could save your precious investment dollars.

“I would also like to thank Prosecutor Buckingham for his work. These charges would not be possible without him.”

The Secretary of State’s office began investigating Garland after receiving a complaint from an investor. The investor contacted the Secretary of State’s office when Garland failed to repay the investment she provided to Garland.  Garland and the victim met to discuss how to create a personal fund to help pay for the victim’s expenses related to her divorce.  He presented himself as a director of commodity trading for Goldman Sachs in New York.  The victim initially invested $5,000 followed by another $5,000 and $20,000 investment later.  Garland asked to borrow $1,000 from the victim to pay medical bills.  It was after she did not receive payment back from the loan that she contacted the Secretary of State’s office. 

Garland turned himself in on November 20, 2015 and appeared in the Hamilton Circuit Court for an initial hearing on November 23, 2015 at 1:15 p.m.  The Court scheduled this case for a pretrial conference on February 11, 2016 and a jury trial on March 8, 2016.

This is still an ongoing investigation. The counts described are allegations. Garland is presumed innocent until proven guilty. Anyone who invested with Steven Garland should contact the Secretary of State’s office at 317-232-6681.
