[s14] KRUSE REPORT: Tackling Illegal Immigration

Yet again, Congress is debating a bill to reform our failing immigration policies that leaves taxpayers here in Indiana spending millions to cover the cost of undocumented citizens.


Since the federal government has neglected to enforce existing immigration laws, we can only hope that something will come out of the discussions taking place in Congress this year. Even though immigration is and always will be a federal issue, the federal government’s lack of enforcement and regulation has compelled states to take it upon themselves to address the problem.


In 2011, the Indiana General Assembly passed Senate Enrolled Act 590, which made various changes to Indiana’s laws concerning the enforcement of federal immigration regulations. There were two key provisions of the law targeting illegal immigration in Indiana:


·         Any local government is prohibited from doing business with a company that hires illegal immigrants.

·         Any illegal immigrant is excluded from collecting state or local benefits such as: welfare, health-care services, college scholarships and financial aid.

The measure also required the Indiana Office of Management and Budget (OMB) to calculate how much illegal immigration costs taxpayers and to make a written request to Congress for reimbursement.


Before this law was passed, there weren’t any concrete figures on how much taxpayers paid each year for illegal immigrants. According to a study by the Pew Hispanic Center, there were an estimated 110,000 undocumented citizens in Indiana in 2010. When OMB completed a cost evaluation on illegal immigrants, the agency found they cost Indiana taxpayers over $130 million per year.


When our law was getting ready to take effect, a federal judge blocked two provisions of SEA 590. This temporary ban will remain in effect until the case is resolved in court.  


With the federal government’s inability to regulate illegal immigration, proactive state policies like Indiana’s help us address the related problems within our state borders. Our law sends a clear message to illegal immigrants that our state will not be a sanctuary for people who are in our country dishonestly and take advantage of our public services funded by tax dollars.
