[INDOT] Public Hearing regarding a proposed bridge rehabilitation project at U.S. 33 over the Elkhart River 4 miles north of S.R. 13 in Elkhart County

The Indiana Department of Transportation will hold a public hearing on Tuesday,
June 4, 2013, at 5:30pm at the Benton Fire Station, 68073 US 33, Goshen, Indiana 46526

The purpose of the public hearing is to offer all interested persons an opportunity to comment on the environmental document, Section 106 document, and preliminary design plans for the proposed bridge project located at US 33 over the Elkhart River, 4.44 miles north of SR 13, Benton Township, Elkhart County. The project proposes replacement of the bridge deck and widening of the existing six-(6) span-concrete arch bridge constructed in 1953 and reconstructed in 1984. The SR 33 Bridge over the Elkhart River (Bridge #33-20-3906A; NBI #10970) is eligible for the National Register of Historic Places (National Register). As part of the Indiana Historic Bridge Inventory project, the bridge was determined to be Non-Select. The bridge has been marketed for re-use for the past six months and information about the bridge can be found on the following INDOT Historic Bridge Marketing website:
Section 106 of the National Historic Preservation Act (NHPA) requires Federal agencies to take into account the effects of their undertakings on historic properties. The proposed project does not involve any properties eligible for the National Register aside from the subject bridge. This project will result in an “adverse effect” under Section 106. The Federal Highway Administration has issued an “adverse effect” finding for the project. In accordance with the NHPA, the views of the public are being sought regarding the effect of the proposed project on the historic elements as per 36 CFR 800.2(d), 800.3(e) and 800.6(a)(4). Pursuant to 36 CFR 800.6(a) (4), the documentation of “adverse effect” specified in 36 CFR 800.11 (e) is available for inspection along with the environmental documentation and preliminary design plans at the following locations:

The public hearing serves as the opportunity for the public to comment on both the Categorical Exclusion (CE) environmental document and the 800.11(e) documentation for Section 106. All comments collected before, during and after the hearing through Wednesday, June 19, 2013, will be taken into consideration. The public hearing will be the last opportunity for a responsible party to step forward and provide the necessary sureties to obtain ownership of the bridge.

Construction of the project will require approximately 0.02 acre of new permanent right-of-way. No displacement of residents or businesses will be involved with this project. Maintenance of traffic will detour traffic during construction using the official state-maintained routes, using portions of US 6 and SR 15. Local routes may be used by local traffic.

The tentative timetables for right-of-way acqui¬sition and construction will be discussed during the formal presentation. Public statements for the record will be taken after the presentation. Individuals interested in participating in the public statement session may sign the speaker’s schedule prior to the presentation.

All comments collected before, during and for a period of two (2) weeks after the hearing will be evaluated and addressed in the final design study report. The preliminary plans will be available for anyone interested in talking to the engineers about the project before and after the formal presentation. Conversations will not be part of the official record.

With advance notice INDOT can make special accommodations for persons with disabilities and/or limited English speaking ability, and persons needing auxiliary aids or services of interpreters, signers, readers, or large print. This notice is published in compliance with Code of Federal Regulations, Title 23, Section 771 (CFR 771.111(h)(1) states: “Each State must have procedures approved by the FHWA to carry out a public involvement/public hearing program.” 23 CFR 450.212(a)(7) states: “Public involvement procedures shall provide for periodic review of the effectiveness of the public involvement process to ensure that the process provides full and open access to all and revision of the process as necessary.”, approved by the Federal Highway Administration, U.S. Department of Transportation on August 16, 2012.
