[ATG] Attorney General’s statement on Indiana Supreme Court opinion in legislative fines case

INDIANAPOLIS – Today the Indiana Supreme Court decided the consolidated legislative fines case, Berry v. Crawford.  The Supreme Court’s majority opinion overturned a lower court and determined that the dispute over fines imposed on members of the Indiana General Assembly is an internal matter that courts cannot decide.   Attorney General Greg Zoeller’s office represented the Speaker of the House, the Principal Clerk of the House and the State Auditor in the litigation, and Solicitor General Thomas M. Fisher argued the case before the Indiana Supreme Court.  Zoeller today issued this statement:


 “The separation of powers is a central pillar of constitutional law.  As state government’s lawyers, we are pleased that the Supreme Court recognized constitutional limits and held that the judicial branch cannot interfere with the internal management of the legislative branch and that the people’s elected representatives in the Legislature must resolve such disputes among themselves,” Zoeller said.
