State should not retroactively tax Hoosiers

The Indiana General Assembly recently voted to override the governor’s veto on House Enrolled Act (HEA) 1546, legislation pertaining to tax administration. Meeting for a one-day session, the Indiana House of Representatives voted 68-23 to override the veto, which cleared the way for a final 34-12 vote in the Senate.

Governor Pence vetoed HEA 1546 following the end of the legislative session. While the act contains some good provisions, the governor expressed concerns regarding language that would retroactively reauthorize a local tax Pulaski and Jackson counties used to pay for jails.

I shared the governor’s concerns. The state should not retroactively approve a tax. In both counties, the authorization for collecting these taxes had expired. However, folks continued to pay the tax. Like the governor, I strongly believe that Hoosiers should not pay taxes they do not owe. HEA 1546 simply applies a Band-Aid approach to resolving the problem, which is not a solution. While the tax does not directly impact our communities, the precedent it sets could eventually be applied elsewhere.  

As your state Senator, I believe that maintaining public confidence in our system of taxation and government is very important. Moving forward, we should do all that we can to ensure that this does not happen again.
