Acts address variety of issues, including improvements to public safety

INDIANAPOLIS—Assistant Senate Democratic Leader Jean D. Breaux (D-Indianapolis) proposed several bills during the recently adjourned legislative session that were approved by the General Assembly and are expected to be signed into law. Most new laws become effective July 1, 2013. Among her legislative initiatives this session were bills aimed at safeguarding Hoosier children and modernizing legislation regarding mental illnesses.

Sen. Breaux co-authored Senate Enrolled Act (SEA) 345, which seeks to minimize the use of dangerous restraints and isolation measures to discipline students. The act creates a state commission to establish rules regarding the use of restraint and seclusion in schools and develop a model plan addressing those issues. Based on the plan, all accredited public, private and charter schools will need to create their own restraint and seclusion guidelines by the 2014-15 school year. The plans will focus on preventing restraints or seclusions that may cause harm, developing requirements for notifying parents, and establishing training guidelines for staff.

SEA 509, co-authored by Sen. Breaux, aims to decrease human trafficking incidents in Indiana. The act modifies the criminal code to include individuals who recruit children under the age of 18 for the purpose of working in forced labor or prostitution. Currently, Indiana’s human trafficking laws only apply to those 16 years old and younger. In addition, children younger than 18 who are sold or transferred for the use of sexual purposes are included under sexual trafficking.

Authored by Sen. Breaux, SEA 267 updates provisions regarding mental health matters in Indiana. The act alters the term “pervasive developmental disorder” to “autism spectrum disorder” and changes “managed care providers” to “community mental health centers.” SEA 267 also removes language regarding nonexistent state developmental centers and requires individuals to seek addiction treatment providers before entering into a treatment program. In addition, the Indiana Commission on Mental Health and Addiction will be tasked during the interim with reviewing Indiana’s mental health crisis intervention operations and recommending the best methods that create and develop intervention teams. 

Co-sponsored by Sen. Breaux, House Enrolled Act (HEA) 1159 provides public school facilities with more flexibility for community use. The act limits the liability placed on schools that offer their facilities to organizations for community physical fitness and exercise programs. Participating schools will be required to post signs during programs to inform participants that they may not be held liable for accidents or injuries that occur in the building. However, schools would still be held responsible for other factors, such as proper employee training and reasonable knowledge of dangerous conditions on the premises.
