[s19] Sen. Holdman: Legislation to Improve Child Services Moves to Governor’s Desk

STATEHOUSE (April 25, 2013) —State Sen. Travis Holdman’s (R-Markle) bill to improve child services in Indiana cleared the Senate and House of Representatives today. It now moves to the governor’s desk for final consideration.

Senate Bill 164 allows prosecuting attorneys to request that a juvenile court file a child in need of services (CHINS) petition, beginning legal action that permits the state to intervene to protect a child. Following the petition’s approval, the prosecutor would represent the interests of the state in the CHINS proceeding.

Prosecutors previously had the ability to file CHINS petitions, but in July 2009, the Department of Child Services (DCS) assumed this responsibility.

“Oftentimes, prosecuting attorneys have a better perspective on a child’s situation because they directly interact with the family,” Holdman said. “But under current law, prosecutors don’t have the authority to begin legal proceedings if they believe that child to be in danger. With this measure, we’re allowing them to directly intervene in a situation that they believe requires state action.”

The structure of the bill originated from the General Assembly’s DCS Interim Study Committee, which Holdman chaired.

Rep. Kevin Mahan (R-Hartford City) is the bill’s sponsor in the House of Representatives.
