[s42] Sen. Leising: Bill Defending Property Rights Passes House

STATEHOUSE (April 9, 2013) — A bill initiated by State Sen. Jean Leising (R-Oldenburg) to exempt some Indiana residents from being forced to join regional sewage districts received bipartisan support in  the House of Representatives with a 76-17 vote earlier this week. 

Current law requires residents living on less than 10 acres of land to connect to a regional sewage district system if their property line is within 300 feet of a sewer line. 

Senate Bill 204 would change the 300-foot requirement to be measured from the structure or source of sewage discharge, rather than from the property line, for certain rural and land-locked properties.

“This issue is especially important to residents living in rural areas with working septic systems. They should not be burdened with thousands of dollars in construction costs to join a sewer district against their will,” Leising said. “I’m trying to provide common sense relief for residents and not burden residents facing this situation.”

SB 204 now returns to the Senate for final legislative approval.
