[r50] Toxicology legislation signed into law

STATEHOUSE —House Enrolled Act (HEA) 1458, which addresses Indiana State Department of Toxicology (ISDT) fees, was signed into law by Governor Pence today. State Representatives Dan Leonard (R-Huntington) and Denny Zent (R-Angola) co-authored the measure.

“The bill allows the ISDT to continue collecting fees in the same dollar amount that they had been collecting as of January 1st of this year,” said Rep. Leonard. “The ISDT will also be allowed to adopt a rule to change the specific amount of the fee.”

HEA 1458 provides that the ISDT may collect the same fees and deposit them in the Breath Test Training and Certification Fund that has been transferred to the state from Indiana University (IU). IU was previously responsible for maintenance on the devices and for the collection of fees for services rendered. 

“This legislation allows the ISDT to charge fees for the purpose of covering the cost of certifying breath test equipment,” said Rep. Zent. “These fees would be charged to the state and local police who use the equipment to breath-test drunk drivers.”

While the ISDT collects fees to cover the cost of certifying equipment, they may also collect fees to cover the cost of training people to operate equipment used at the department. The training ensures that not only is breath testing equipment being provided, but it is also being operated properly.

Current Indiana law offers no specifics for the ISDT’s funding and ability to collect fees for the services rendered. HEA 1458 remedies the situation by allowing the department to collect fees independently. 


Rep. Leonard (R-Huntington) represents Huntington County and portions of Allen and Wells counties. Rep. Zent (R-Angola) represents most of LaGrange and Steuben Counties.
