Lanane bill safeguarding seniors moves to governor for approval

INDIANAPOLIS—On Tuesday, the Indiana Senate gave final approval to a bipartisan proposal authored by Senate Democratic Leader Tim Lanane (D-Anderson) protecting Hoosier seniors from financial scams and fraud.

“I am very excited to see this measure moving forward with a great amount of support from both chambers,” Sen. Lanane said. “Through the joint effort of the Indiana Attorney General, this bill will be an extremely important step toward protecting the savings and investments of our senior citizens.”

Senate Bill (SB) 382 would create the Senior Consumer Protection Act, which defends senior citizens 60 years and older from illegal misuse of assets through fraud, extortion or intimidation. The bill would not apply to securities fraud regulated under the Indiana Secretary of State.

Individuals who commit financial abuse of seniors would have their assets frozen, be issued an injunction and have to pay investigation or prosecution costs. The bill would also increase civil penalty costs from $50 to up to $5,000 per violation. Violations of trust, including spouses, children and attorneys, would result in stiffer penalties.

This proposal is an effort in collaboration with Indiana Attorney General Greg Zoeller and would authorize the involvement of the Indiana Attorney General in seeking means to protect seniors from dissipation of assets.

After gaining final passage from the Senate by a unanimous vote, SB 382 will now move to the governor for his approval.
