[s7] Sen. Hershman: House Approves Bill to Deter Public Assistance Fraud

STATEHOUSE (April 16, 2013) — State Sen. Brandt Hershman’s (R-Buck Creek) proposal to deter public assistance fraud in Indiana passed the House of Representatives yesterday by a vote of 92-0. Senate Bill 559 now returns to the Senate for final legislative review.

The bill includes multiple provisions aimed at ensuring the integrity of taxpayer-funded assistance programs such as Medicaid, Temporary Assistance for Needy Families and the school lunch program. Among other changes, the bill:

  • Expands the state’s authority to investigate fraudulent Medicaid claims and provides whistleblower protection to employees who help inform officials of Medicaid fraud.
  • Requires the state to inspect health-care providers at high risk of Medicaid fraud.
  • Requires ATM vendors to program their machines so debit cards for public assistance can’t be used at prohibited facilities like liquor stores, casinos and adult entertainment facilities.
  • Requires the Department of Education to audit applications for reduced-price/free school lunches to confirm applicants meet the income qualifications.

“With many Hoosier families struggling, we must ensure that tax dollars are going to those who actually need them,” Hershman said. “Improving accountability will make a more secure system for preventing falsified claims and investigating them when they happen.”

SB 559 will also prevent fraudulent claims for tax benefits by requiring state agencies — like the Department of Correction and the Department of Health — to share data relevant to identity fraud with the Indiana Department of Revenue (IDOR) at no charge.

“This comprehensive review network will provide added accountability and improve our tax system as a whole,” Hershman said. “I’m grateful for Rep. Eric Turner’s support in getting this legislation passed through the House, and I’m confident these changes will ultimately prevent abuse of our taxpayer dollars.”
