[ATG] Attorney General’s statement on Supreme Court ruling in Lake precinct case

INDIANAPOLIS – A state law requiring Lake County to take steps to consolidate small election precincts is constitutional, the Indiana Supreme Court ruled today. 

The state’s highest court today ruled in State v. Buncich and reversed a Lake County trial court which had found the 2014 statute was unconstitutional special legislation.  The Supreme Court ruled 4-1 today that the statute, requiring a study of consolidating small precincts and implementation of the study, is constitutional.  As the lawyer for state government, the Indiana Attorney General’s Office defended the statute the Legislature passed from the legal challenge plaintiff’s lawyers filed.

“The decision of the Supreme Court upholds the statute that addressed a unique situation in Lake County. The Legislature determined that realigning and consolidating small precincts would result in a savings of administrative costs to taxpayers.  As the state government’s lawyer it's my duty to defend the statute and the Legislature’s policymaking authority, and I am pleased with the Court's ruling,” Zoeller said.

After the trial court found the statute unconstitutional last year, the State appealed, and the legal challenge was automatically heard in the Indiana Supreme Court, which conducted oral arguments June 4 and ruled today. The case now returns to the trial court.

Zoeller today thanked Deputy Attorney General Stephen Creason, chief counsel of the Appeals Division in the Attorney General’s Office, as well as Deputy Attorneys General Larry Allen, Kyle Hunter, Betsy Isenberg and Jefferson Garn for their work on the case.
