Mrvan proposal extending child abuse statute sent to governor

INDIANAPOLIS—The Indiana House of Representatives recently passed a bill authored by State Senator Frank Mrvan (D-Hammond) that would extend the period of time a victim of child sex abuse may press charges against an offender.

“Victims of child sex abuse are confronted with horrific obstacles to overcome,” Sen. Mrvan said. “By extending this deadline, we can bring more offenders to justice and create safer communities for our children.”

Senate Bill (SB) 142 extends the legal timeframe for both civil action against and criminal prosecution of cases of child sexual assault. Currently, an individual who files a civil suit for child sex abuse is subject to the same time constraints as someone filing for other damages, such as an auto accident. SB 142 would extend this timeframe to the longer of either seven years after the offense or four years after the victim leaves the care of the alleged offender. To criminally prosecute an offender, SB 142 doubles the available timeframe from five years to ten years after the event or four years after the victim leaves the care of the alleged offender.

Many children do not report cases of abuse and as many as 90 percent of offenses are committed by someone the child knows. SB 142 seeks to give victims adequate time to come forward and serve justice to abusers.

SB 142 passed unanimously out of the House of Representatives by a vote of 97-0 and the Senate, 49-0, and now moves to the governor for final approval.
