[DWD] Monticello Man Pleads Guilty to Unemployment Insurance Fraud

INDIANAPOLIS  – Monticello resident Kenneth Asbury, Jr., 44, pled guilty Monday, January 28, 2013 in White County Superior Court to unemployment insurance fraud, a Class C Felony. Asbury purposefully defrauded the system by collecting unemployment insurance benefits while working full-time. 

The investigation began when an Indiana Department of Workforce Development (DWD) employee confirmed Asbury was working and receiving wages while claiming unemployment insurance benefits. Using agency records and information from Asbury’s employer, DWD investigated and was able to verify he worked while claiming unemployment insurance benefits. 

“You can’t collect unemployment insurance if you are working full-time,” said Scott B. Sanders, Commissioner of the Department of Workforce Development. “This is a case of fraud, plain and simple. We thank Mr. Asbury’s employer for helping us hold him accountable.”  

Asbury was sentenced to 4 years in prison, but will have work release privileges as long as he maintains employment and adheres to strict conduct standards. He was also ordered to repay the agency $33,943 he received in benefits, as well as $25,975 in penalties and interest, for a total of $59,918. 

DWD receives wage reports and new hire data from Hoosier employers documenting who is employed and receiving compensation. The agency uses this information to ensure people are not collecting unemployment insurance benefits while working.

Your efforts will help ensure tax dollars are spent wisely and unemployment insurance benefits are only paid to people who are eligible to receive them. You do not need to provide your name or any other identifying information in order to file a complaint in regards to unemployment insurance fraud.
