STATEHOUSE – State Rep. Kevin Mahan (R-Hartford City) authored several pieces of legislation that were passed out of the Indiana House of Representatives on Tuesday.

House Bill (HB) 1098, authored by Rep. Matt Lehman (R-Berne) and co-authored by Rep. Mahan, passed with a unanimous vote. The bill has two main provisions. First, it specifies that an insurance company may not pay noneconomic damages on a motor vehicle insurance claim for a loss sustained by an uninsured motorist who is over 18 years of age. Noneconomic damages refer to things such as pain and suffering or disfigurement. Second, HB 1098 provides that an uninsured motorist cannot recover noneconomic damages after an accident unless the driver of the other vehicle is convicted of a crime in connection with the accident.

HB 1124, authored by Rep. Mahan and co-authored by Reps. Jud McMillin (R-Brookville) and Greg Steuerwald (R-Avon), passed with a unanimous vote. This bill requires a person who unlawfully parks in a handicapped space or receives a seatbelt citation to pay a late payment fee of $25 to the city or town court if they fail to pay on time.

“HB 1124 gives cities and towns more discretion as to what they collect for violations,” said Rep. Mahan. “This bill will assist in preventing cities and towns from spending more than they receive under these circumstances.”

HB 1151, authored by Rep. Wendy McNamara (R-Mount Vernon) and co-authored by Reps. Mahan and McMillin, passed with a unanimous vote. This bill creates the Blue Alert program, which is designed to notify the public when a law enforcement officer is killed, seriously injured or missing in the line of duty.
