INDIANAPOLIS – The Court of Appeals of Indiana will hear oral argument in a criminal appeal from Clark County at 10:30 a.m. Dec. 12. The argument will occur in the Horseshoe Foundation Assembly Center at Ivy Tech Community College Southern Indiana, Sellersburg.
The public and news media are welcome. News organizations may ask permission to record the event with still or video cameras by faxing their requests, including contact information, to Court Administrator Steve Lancaster at 317-233-4627. Requests must be received at least 48 hours before the argument.
A panel of Judges John G. Baker, Edward W. Najam Jr. and Melissa S. May will hear the case on appeal from Clark Superior Court.
The case name and number are Gilbert v. State, 10A05-1204-CR-220, in which Nathan Carl Gilbert appeals his convictions of and sentence for four (4) counts of Class B felony burglary, arguing that the trial court’s entry of his convictions violated the Interstate Agreement on Detainers and that the manner in which the trial court conducted his sentencing hearing violated both his right to due process under the 14th Amendment and his right to counsel under the Sixth Amendment
The court is visiting Ivy Tech by invitation of Leadership Southern Indiana, a nonprofit organization that promotes civic education and involvement in Clark and Floyd counties.
The Court of Appeals hears oral arguments across Indiana to enable Hoosiers to observe the court in action and learn more about its indispensable role in Indiana government. Including this event, the court has held 350 “Appeals on Wheels” at law schools, colleges, high schools and other venues since 2000.
