STATEMENT: Lanane: Governor’s inaction over State Board sends mixed signals

INDIANAPOLIS – On Friday, Senate Democratic Leader Tim Lanane (D-Anderson) released the following statement in response to the dismissal of the State Superintendent’s lawsuit against the State Board of Education concerning the alleged violation of the Open Door Law regarding the state’s A-F school grades:

“The court’s ruling today should in no way be construed as a ruling on the alleged violation of the Open Door Law or the issue of calculating school grades. The statute is clear, that responsibility falls squarely with the Superintendent and the Department of Education.

“It seems to me that since the court has granted the Attorney General’s motion, Attorney General Zoeller now has a duty to render an opinion as to the validity of the claims contained within the complaint.

“I believe all parties would benefit from the Attorney General’s forthright opinion on this matter and it would go a long way toward reaching common ground on this issue.

“That said, the continued encroachment by the State Board of Education on Superintendent Ritz’s statutory authority appears to be a systematic attempt to wrestle control from a constitutionally-mandated officeholder, empowered by a majority of Hoosiers.

“With every new distraction supplied by the Board, it seems more and more likely that this is a coordinated effort to undermine the Superintendent’s role and thusly deny the determination of a majority of Hoosier voters.

“The governor continues to stand idly by as his appointed board does what it can to interfere with and upend the process. Time and again he has stated that the best interests of our students should come before politics but his inaction on this matter sends mixed signals.”
