[ATG] State wins "cold beer lawsuit", statute successfully defended

INDIANAPOLIS -- Ruling in the State's favor in the "cold beer lawsuit," the U.S. District Court for the Southern District of Indiana upheld a state law prohibiting retail convenience stores from selling chilled beer, rejecting a plaintiff's legal challenge that sought to invalidate the law.

Late Monday, Chief Judge Richard L. Young denied the plaintiff's motion for preliminary injunction in the lawsuit, Indiana Petroleum Marketers and Convenience Store Association et al. v. Alex Huskey, Chairman of the Indiana Alcohol and Tobacco Commission, and granted the State's motion for summary judgment.  As state government's lawyer, the Indiana Attorney General's Office represented the Alcohol and Tobacco Commission and its chairman, and defended the state statute the Legislature passed from the challenge the plaintiff brought to the law's constitutionality. Attorney General Greg Zoeller issued this statement:

"The statute we successfully defended reflects the current decision of the people's elected representatives in the Legislature. The subject has been debated for many years but the appropriate forum for those who disagree with the state law to advocate for policy changes is in the state Legislature not the courts," Zoeller said.

Zoeller thanked the attorneys in his office assigned to the case who prevailed in court, including Deputy Attorney General Kenneth Joel, Deputy Attorney General Aileen Wenzel and other deputy attorneys general who worked on the case.
