[r65] Rep. Koch’s Privacy Bill Signed into Law

STATEHOUSE – A bill that would allow Hoosiers to enjoy greater privacy protections, authored by State Representative Eric Koch (R-Bedford), was signed into law by Governor Mike Pence. Rep. Koch attended the bill signing ceremony today at the Statehouse.  

“With technology continuing to evolve faster than the law, it was crucial to take steps to give all Hoosiers the peace of mind that common and reasonable expectations of privacy are still guaranteed in Indiana,” said Rep. Koch. “I am pleased with Gov. Pence’s support on House Enrolled Act (HEA) 1009, as well as statewide support from the General Assembly, the Indiana State Police and other agencies.”

HEA 1009, the Indiana Privacy Protection Act, would prohibit warrantless searches of electronic communications, user data and geolocation information, put limits upon use of tracking devices, surveillance cameras and drones and prohibit warrantless searches using these technologies.  Exceptions would be permitted for legitimate uses of these technologies and exigent circumstances.

“With today’s technology, miniature cameras and tracking devices can be used to secretly record images and track locations,” said Rep. Koch. “Almost any form of data can be secretly captured, quickly stored and easily searched and cross-referenced … literally forever. HEA 1009 will work to reduce issues that inevitably emerge from these technological advances.”
