[r50] Unemployment Insurance Bill passes the House

STATEHOUSE —House Bill (HB) 1346, which deals with unemployment insurance (UI), passed out of the House on Tuesday evening with a 65 to 28 vote. State Representative Dan Leonard (R-Huntington) authored the measure. 

“The largest issue HB 1346 addresses is the elimination of the burden of proof during the rulings in UI appeals cases,” said Rep. Leonard. “Currently, if the employee or employer is unable to be present for the hearing regarding the determination of eligibility for benefits, the absent party automatically loses the case.” 

HB 1346 is the third in a series of bills that the Indiana General Assembly and the Indiana Department of Workforce Development (DWD) have worked jointly on reforming the state’s UI fund, policies and procedures.

“Altering UI policy is a delicate process,” said Rep. Leonard. “Any time the legislature makes adjustments, we approach the issue with great prudence and foresight. I believe this measure addresses an immediate need, while also keeping an eye towards the future.” 

Specifically, HB 1346 allows for an administrative law judge (ALJ) to make the ultimate ruling in UI cases, based on evidence presented during the hearing. 

“By eliminating the burden of proof in UI eligibility cases, the playing field will be leveled for both the employers and the employees,” said Rep. Leonard. “Allowing an ALJ to objectively weigh both sides of the case will allow him or her to make the fairest possible ruling.”
