Martin University hosts Court of Appeals at Law Day Observance

INDIANAPOLIS – The Court of Appeals of Indiana will conduct oral argument at Martin University’s annual Law Day observance on Friday, April 26. Argument in Speers v. State will start at 10 a.m. in the university Gathertorium and last about one hour. The public is welcome.

A panel of Chief Judge Margret G. Robb, Judge Ezra H. Friedlander and Judge Terry A. Crone will hear the case on appeal from Morgan Superior Court.

Reporters, including student journalists, may ask the court’s permission to record the argument in audio, video or photographic formats. Requests must be faxed to Court Administrator Steve Lancaster (317-233-4627) at least 48 hours before the scheduled start of the argument. Per Indiana Supreme Court order, all cameras must be tripod mounted and cannot employ flash or strobe lighting.

About this case: Following a jury trial, Scott Speers was convicted of burglary and theft. Speers now appeals and raises the following issues:

1. Did the admission of certain DNA evidence violate the Confrontation Clause of the U.S. Constitution?

2. Did the trial court properly deny Speers’ motion for discharge based on an alleged violation of Speers’ speedy trial rights?

3. Did the trial court properly deny Speers’ motion for a mistrial based on alleged prosecutorial misconduct?

The Court of Appeals hears oral arguments across Indiana to enable Hoosiers to observe the court in action and learn more about its indispensable role in Indiana government. The court has conducted more than 360 “Appeals on Wheels” events since its 2000-2001 centennial.
