Taylor University hosts Court of Appeals oral argument in parental rights case

Mother challenges evidence behind trial court’s decision to remove children from her care

 

INDIANAPOLIS – A Marion County woman will contest her loss of parental rights during an April 12 oral argument before the Court of Appeals of Indiana at Taylor University. The argument will start at 1:30 p.m. in the Euler Science Complex and last about one hour. This will be the court’s sixth visit to Taylor University.

A panel of Judges Paul D. Mathias, Terry A. Crone and Cale J. Bradford will hear the case, L.S. v. Indiana Department of Child Services, on appeal from Marion Superior Court.

Reporters, including student journalists, may ask the court’s permission to video or photograph the argument. Please fax the Court Administrator (317-233-4627) at least 48 hours before the argument. All cameras must be tripod-mounted and cannot use flash or strobe lighting.

About this case: L.S. (“Mother”) appeals the involuntary termination of her parental rights to her children, A.D.S. and A.S. (collectively, “the Children”). Due to concerns regarding Mother’s mental health, criminal behavior and substance abuse, the Indiana Department of Child Services’ local office in Marion County (“MCDCS”) alleged that A.D.S., and subsequently A.S., were Children in Need of Services. MCDCS later moved to terminate the parent-child relationship between Mother and the Children. Mother challenges whether there was sufficient evidence to support the trial court’s order terminating the parent-child relationship.

The Court of Appeals hears oral arguments across Indiana to enable Hoosiers to observe the court in action and learn more about its indispensable role in Indiana government. The court has conducted more than 360 “Appeals on Wheels” since its 2000-2001 centennial.
