[R53] Regulations on outdoor event equipment passes both houses

STATEHOUSE — House Bill (HB) 1069, authored by State Representative Bob Cherry (R-Greenfield) and coauthored by State Representative Bill Davis (R-Portland), passed the Indiana Senate on Tuesday with a vote of 40-7.

HB 1069 keeps temporary rules in place regarding the requirements to use outdoor event equipment until Jan. 1, 2016. This will allow the Fire Prevention and Building Safety Commission more time to adopt permanent rules.

“This bill stems from the Indiana State Fair stage rigging collapse in 2011,” said Rep. Cherry. “That was a very tragic event in our state’s history. I am pleased to see this bill move onto the governor’s desk. Once implemented, the bill will allow for an increased review time for the safety commission as well as additional necessary precautions to ensure such an event never happens again.”

HB 1069 makes other rules permanent, including the addition of “outdoor event equipment” to the definition of a Class 1 structure. A Class 1 structure is a building or structure that is intended for public use.

An amendment added in the Senate applies outdoor event equipment regulations to locations for which an amusement and entertainment permit is required.

As an additional layer of protection, HB 1069 also gives the Executive Director of the Indiana Department of Homeland Security the ability to adopt rules governing emergency action plans or emergency response plans for outdoor performances where outdoor event equipment is used.
