On appeal, State says bad roads are bad reason to suppress evidence of driver’s impairment


INDIANAPOLIS – The Court of Appeals of Indiana will hear oral argument in State v. Keck at Paoli Jr.-Sr. High School on March 19, 2013. The argument will start at 10 a.m. in the school auditorium and last about 40 minutes.


A panel of Chief Judge Margret G. Robb, Judge Patricia A. Riley and Judge Melissa S. May will hear the case on appeal from Putnam County. The court is appearing by invitation from Orange Circuit Court Judge Larry R. Blanton.


Reporters, including student journalists, may ask the court’s permission to video or photograph the oral argument. Requests must be faxed to Court Administrator Steve Lancaster (317-233-4627) at least 48 hours before the scheduled start of the argument. Per Indiana Supreme Court order, all cameras must be tripod mounted and cannot employ flash or strobe lighting. All recording is limited to the oral argument itself; no recording will be allowed during a short Q/A between the judges and audience that will follow the argument.

About this case: Appellee was stopped by police for driving on the left side of the road. Appellee moved to suppress evidence arising out of the stop, arguing he should not have been stopped because he couldn’t drive on the right side. The trial court found “driving left-of-center has become a necessity” because of county road conditions and granted the motion. The State appeals. 


The Court of Appeals hears oral arguments across Indiana to enable Hoosiers to observe the court in action and learn more about its indispensable role in Indiana government. This will be the court’s 359th “Appeals on Wheels” event since the court’s 2000-2001 centennial.
