[s21] Sen. Buck’s Bill Reforms Involuntary Manslaughter Penalty, Passes Full Senate 45-2

STATEHOUSE (Jan. 24, 2013) — State Sen. Jim Buck’s (R-Kokomo) bill to change the penalty for a vehicular involuntary manslaughter from a Class D felony to a Class C felony passed the Senate on third reading  today with a vote of 45-2.

Current Indiana law states that most involuntary manslaughter cases are Class C felonies, but vehicular involuntary manslaughter is classified as a D felony.

“The current law said that accidentally killing someone with a car was the same offense as tampering with a car odometer,” Buck said. “My bill to correct this inequity received bipartisan support in the Senate, and I look forward to working with my colleagues in the House on this issue.”

Buck authored the legislation in response to the death of Kokomo resident Jeremy Bagwell, who was killed in 2011 while working at a road construction site.

Senate Bill 119 now moves on to the House for further consideration.
