Rep. Frye Supports Ban on Dangerous Synthetic Drugs

STATEHOUSE – State lawmakers commended Gov. Mitch Daniels for signing a bill into law that strengthens the state’s ban on dangerous synthetic drugs designed to mimic the effects of marijuana and cocaine. Rep. Randy Frye (R-Greensburg) supported House Enrolled Act (HEA) 1196, which was authored by State Rep. Milo Smith (R-Columbus) and sponsored by State Sens. Ron Alting (R-Lafayette) and Jim Merritt (R-Indianapolis). 

In addition to banning dangerous synthetic drugs, this legislation also holds retailers that do not comply with the crack-down accountable for their illegal actions. 

“We’re acting in an expedient manner to address this widespread problem,” said Rep. Frye. “These synthetic products are incredibly dangerous, and young kids are being hurt in the process.”

With the bill’s enactment today, more than 60 chemical compounds found in synthetic drugs like “Spice” and “Bath Salts” have been added to the state’s list of illegal substances. 

“This legislation has come to fruition after months of collaboration with state legislators and law enforcement officers,” said Rep. Frye. “These synthetic drugs have caused at least 20 deaths, so we needed to act quickly to prevent the number from increasing.”

In an effort to prevent illicit drug manufacturers from slightly changing ingredients and skirting laws in the future, the law also bans compounds chemically derived from existing illegal drugs. 

Retailers that continue to sell synthetic marijuana and other banned synthetic drugs will be stripped of their retail merchant certificate of business, shutting them down for one year. Affiliates of the business – including owners, officers, partners, directors or managers – will be banned from obtaining any other retail merchant certificates for one year. Employees caught distributing these substances without the knowledge of their employer would be subject to prosecution as well.

“I commend the large number of retailers who understood the health risks of these drugs and refused to sell them,” said Rep. Frye. “Unfortunately, other retailers didn’t have the same consideration for the safety and well-being of young Hoosiers, and, now, those who refuse to play by the rules will suffer the consequences.”
