Rep. Borders: Pro-Military, Pro-Family Legislation Moves to Governor’s Desk

STATEHOUSE—State Representative Bruce Borders (R-Jasonville) authored House Bill (HB) 1065, which will allow a parent who has received military deployment orders to delegate their parenting time to a person who has a close relationship with their child if the court determines that it is in the child’s best interest. The bill passed out of the House and Senate unanimously. 

“This is a pro-military, pro-family bill that I am eager to see signed into law by Governor Daniels,” said Rep. Borders. “Before, if someone went through a divorce and then gets deployed afterwards, there has been no way of designating visitation rights to someone in their family. This would allow them the comfort of knowing that while they are away serving our country their son or daughter is able to spend time with a loved one.”

HB 1065 allows a parent who has received military temporary duty, deployment or mobilization orders to hold an expedited hearing in determining or modifying custody or parenting time. If the military duties of a parent have a material effect on the parent’s ability to appear in person, they may present testimony and evidence by electronic means.

“Soldiers face an immense amount of pressures, and this is one less thing they’ll have to worry about while they’re away, said Rep. Borders. “This legislation plays a major role in the lives of many throughout our state. They can now feel at ease and be assured that their visitation rights will not fall to the wayside and can be designated to someone in their family circle.”

HB 1065 now moves to the Governor’s desk to await his signature.
