Ford Co-Sponsors Curfew Bill

(STATEHOUSE) The Indiana Senate today passed a curfew measure, co-sponsored by Senator David Ford ( R-Hartford City ), which allows children to be out after curfew if they have written permission from their parents.

“Curfews protect the children as well as the public.” Ford said. “The challenge was finding a way to enforce curfew that could not be challenged in the Federal courts.”

State law currently says children between the age of 15 and 17 cannot be in a public place between 1 and 5 a.m. on Saturday or Sunday or between 11 p.m. and 5 a.m. on weekdays. The curfew law has been challenged in court a number of times by the Indiana Civil Liberties Union.  The curfew also applies to young people's driving privileges.

The exception contained in House Bill 1232 is modeled after Indianapolis ' local curfew ordinance. Thus far, Indianapolis ' ordinance has not been challenged in court.

HB 1232 passed the Senate 50-0, and it will now return to the House of Representatives for further action.

Senator Ford represents portions of Grant, Blackford, Wells, Allen, and Adams County .
